Discount for early repayment of a debt

We have already discussed the prohibition of riba (usury) with its two categories, riba an-nasi’a (in loans) and riba al-fadl (in exchanges).
See the details:
The principles of Islamic finance
We thus know, as described in the article linked above, that commercial conduct in Islam is based on transparency and the absence of gharar, among other things. One may neither cause harm (darar) to anyone nor suffer such harm, and the consent of both contracting parties is required.
If a debtor wishes to repay early, the contract must not stipulate and make conditional a discount on account of this early repayment. That is the meaning of da’ wa ta’ajjal.
Ibn Abi Zayd al-Qayrawani (d. 380) says in his Risala, chapter 34, sales and related contracts:
“Cancelling part of the debt in exchange for early payment of another part, or postponing the due date of the debt in exchange for increasing it, are unlawful.”
What we have just stated is one version among the Hanafis, and the view of Malik, ash-Shafi’i and what is known of the fiqh of Ahmad. Other scholars permit this discount in the event of early repayment and do not consider it riba.
The eminent Andalusian scholar Ibn Rushd, in his Bidayat al-mujtahid, cites all the opinions with their evidence on this subject (see Bidayat al-mujtahid by Ibn Rushd, volume II, page 228 (section: the five foundations of riba) and 244).
Those who forbid this practice argue that in this case there is money in exchange for time (remitted), and harm suffered by the creditor.
It has been authentically reported that Ibn ‘Umar (may God be pleased with him) was asked about a creditor who grants a discount to the debtor in exchange for early repayment of the debt (before its due date), and he disliked this and forbade it.
In the Muwatta of Malik: a man named ‘Ubayd sold wheat at the market on deferred terms. He wished to travel to Kufa, and those who had contracted the purchase offered to pay him at once if he gave them a discount. ‘Ubayd asked the opinion of the great Companion Zayd Ibn Thabit, who replied: “Do not feed on this, and do not feed it to others.”
Finally, if this discount is voluntary (a charitable gift) without being a condition, the ruling is no longer the same: if the creditor voluntarily waives part of the debt at the moment the debtor repays it early, this is permitted.
Allah says in the Qur’an (surah 2, verse 280):
“If your debtor is in difficulty, grant him time until he is able to discharge his debt. If you only knew what merit you would earn by granting him a gracious remission, in whole or in part!“
Zayd ibn Sa’na, a Jewish scholar of Medina, came to the Prophet to demand his debt. He pulled the garment from his shoulder, seized him roughly by the collar and said to him harshly:
‘You, the Banu ‘Abdul-Muttalib, you put off (tumatilun) paying your debts!’ ‘Umar then rebuked him and raised his voice. The Prophet smiled and said to him: ‘He and I needed something else from you, O ‘Umar: that you should urge me to settle my debt properly, and that you should urge him to claim what is owed to him in a proper manner.’ Then he added: ‘There are (in fact) three (days) left until the term (of the debt).’ And he ordered ‘Umar to pay him and to give him twenty measures (sa’) in addition, for having frightened him.
This was the cause of this man’s entry into Islam. He said: ‘There was no sign among the signs of the prophethood of Muhammad that I did not recognise, except two: his forbearance prevails over his anger, and excessive blind provocation only adds to his forbearance. So I tested him with this matter of the debt. And I found him then as described (in the ancient books). As for my debt, give it to the poor among the Muslims.’ (Reported by Ibn Hibban (1/521))
